Recall of Vapeman branded products
The MHRA have instructed the manufacturer of Vapeman branded products to withdraw all products from sale in Great Britain (GB).
The Authorised Representative (AR) has not completed the notification process and therefore the products are deemed “unnotified” and must not be offered for sale.
It is important when sourcing supplies of any e-cigarette or e-liquid product, that you check that a compliant notification has been published.
If you cannot find the product on the MHRA’s website, ask your supplier to confirm that it has been published and provide details to enable you to confirm the products status. If a product has yet to achieve publication status, they must not supply it to you, and it is illegal for you to offer it for sale.
The IBVTA have sought the advice of both the MHRA and our Primary Authority, Kent County Council Trading Standards.
If you sell Vapeman branded products in your store or on your website, you are legally required to:
- Remove all Vapeman products from sale immediately.
- Seek assistance from your supplier regarding disposal/return of the products. Report any lack of assistance to your local Trading Standards office, including copies of all correspondence and invoices.
- If you are a wholesaler of Vapeman products, you are legally required to instigate a localised recall of Vapeman products. You are legally required to contact your customers who have purchased the products and ask them to return them to you. You are also legally required to place a recall notice up in your business premises advising your customers of the recall.
***Note that this pertains to Vapeman branded products only (eg Vapeman Solo, Vapeman Solo 600, Vapeman Solo Mini, Vapeman Solo Bar Pro, Vapeman Solo X, Vapeman Solo +, Vapeman Solo Legend etc.) and should not be confused with UK based businesses with a similar name to “Vapeman”.
Trading Standards Officers may carry out compliance visits to premises they suspect of selling Vapeman branded products. A business found to have Vapeman products exposed for sale will have the products seized and enforcement action considered. This enforcement action can include prosecution.
